On Monday (June 24), at 4 pm, the trial resumed after a break of a week, the second session of the trial against the 13 workers. There, as it was expected, the Videlist court rejected "nullity request" presented at the 1st session by lawyers who defended the workers, led by Dr. Forgueras, Dr. Razuri and Dr. Luciani, among others.
Throughout the second session of the trial, the judge Lembeye spent her time denigrating the workers, treating them as illiterate and human scum, mocking their employment status and even she called them low level "changarin”. No one can be surprised at the attitude of this right wing and anti-labor judge because with Ruata Leone, they are judges who have ordered all the repressions and persecutions against all oil workers in Santa Cruz.

Rejecting the nullity request, the judges Lembeye, Monelos and Olivera, and prosecutors made ​​it clear that their attempts to charge and condemn -with an arsenal of forgery, conspiracy and false evidence extracted under torture- the workers who have been taken to this real gallow. In this way the imperialist oil companies and the government of Kirchner, with their judges, prosecutors and murderous repressive forces, supported by the opposition, act preparing for revenge against the whole labor movement.

In this trial, the judge and the magistrates worked as judge and interested party, because they act together with the complaint and prosecutors. So is the case that the questions asked ​​by the prosecutors and the complaint were clarified, highlighted and topped by this triumvirate of fascists judges of oil companies.


The fascist court

This court rejected the nullity request of the defense, and accepted the "request of taking to court". This was based on the involvement of everything worker or resident in the demonstration in February 6, 2006, against the city hall warden Las Heras / Sta. Cruz, demanding the release of the spokesman of the oil workers strike, "was taken as a crime."
This means that by the mere participation in a demonstration for a basic demand to release a union leader, is consider a crime of the utmost gravity. In this way they do not take into account that it was the police the one who brutally repressed the peaceful demonstration of the workers and people, which was part of the fight taken by the workers against income tax and all the workers the labour agreement of oil, and as a product of a social uprising the repressor Sayago died, at a time when only the police was armed.
Very quick, including this Videlist-fascist court finished the democratic and public freedoms established in the National Constitution, the right to protest, to demonstrate, to strike and transformed it into A CRIME.

Let’s be honest. The boss state and the judges have this device, because in that way they have justified that kept Las Heras people in a open-air prison, because this is what they have transformed the city with its state of siege. This siege was not mere form, but real and content. The one involved in a demostnration mobilization commits a crime. All workers were prisoners, are confined, with their democratic rights curtailed, without the right to fight for their demands, at the risk of committing a "crime". They are Videlist judges with a militarized city. So the bosses impose to the masses the ideal state, so the oil companies and employers can super-exploit the workers to their liking.

We are in Las Heras facing a town imprisoned and 13 oil workers lynched: that is the revenge and punishment of the oil companies, the Kirchner government, opposition right wing and corrupt judges.

In this "taking to court" approved by the court, they based their arguments for the intervention of Gendarmerie, the police special forces, etc. It was to confront a group of workers organized and trained to deal equally the repressive forces of the state and that this resulted in the death of repressor Sayago. They want to show to the starving workers who fought for and against slavery wages, and with the people who were violently and bloodily repressed by the police as if they were murderers ... as if they were a "factory guerrilla". So Videla justified the slaughter and bloodshed on the working class and youth.

In this "request taking to court" is hidden that there were a union fight of the oil workers of north of Santa Cruz and as a consequence of this fight today all the oil workers are paid in their wage paid almost $2000 in the point of the of the agreement called “social peace”, which was conquered in February 2006 which the strike was stop and return to work. 30 days after the agreement was signed, there was the most brutal repression against the workers.

As a consequence, the Videlist trial rejecting the “nullity request” presented by the lawyers who defend the workers, affirmed that the announcements for torture suffered by the arrested and dozens of testifiers were not presented o time, therefore today there is no validity to carry on the trial against the workers, prepared based on repression, torture and terror as in the dictatorship times. THE VIDELIST TRIAL AGREE ON TORTURE, BECAUSE THE ANNOUNCE OF THE TORTURED WORKER AND THREATEN WAS NOT DONE IN TIME! This would put Videla and Camps flush.

We have reported that they are Videlists judges, and the existence of fascist police court, which have already doomed the comrades. Left Lawyers have told us that it was not so. They said this was like any court, in "democracy".

What are they talking about? This is democracy for the rich, the cruelest dictatorship of capital sweetened wrapped with attractive paper. But in this trial has taken all "democratic" paper and sweetener. In this court acts without disguise and acts the "justice" openly. A class justice, bosses and to attack the workers who have rebelled. Indeed we are in any bourgeois court but with the particularity that this has taken away the disguise.

The lawyers of the left of system wondered that we denigrate judges as fascists. But why are these people surprised that this "bourgeois" democracy (very well in quotes) has fascist judges and fascist army guys? What are these people talking about? What Videla and General Pinochet, don’t they come for the "democracy"? Why are they surprised? If the most "democratic" judge, it is so it can better legitimize jail and repression of the people. When the bourgeoisie has to show their fascist judges sample, it does it. This is how they defend their democracy, theirs, that of the rich. The oil companies of plundering the nation. They are using all their employees and agents to defend their profits.

Moreover this regime, as it is shown with this trial, and this request to take to court as the basis of lynching the workers of Las Heras, was built from '83 with all the judges of the dictatorship, which is were given a budget and a amount of money to support the bourgeois state almost equal to that of the Ministry of Defense. From the caste of judges and prosecutors went all search warrants with the police and gendarmerie killer massacred in Mosconi, Cutral Co, Fuentealba, the December 20, 2001 and some others.

There are not only fascists judges defending democracy but "democratic" politicians holding fascist governments such as Videla. Otherwise, what are the thousands of mayors given by UCR and PJ to the military dictatorship? The one they called for making an example to the people in the Rodrigazo and Cordobazo which questioned the existence of the state bourgeois. The bourgeoisie uses all its agents, including those who flatter their democratic judges and say that by "peaceful means" without fighting, we release the prisoners, we conquer wages and that is achieved from the parliamentary seat that they achieved. We are in Las Heras, along the defendants, we do not believe it. The first failure of this court paved the way for the lynching of the workers of Las Heras. But we still have time.

The trial continues and the Videlist judges start their plan for revenge. Unfortunately, the workers in Las Heras who are in front of the court do not have a powerful demonstration of the working class to siege these courts of the transnational companies. Here aren’t all the ones that should be. The union bureaucracies remain still and silent and unfortunately FIT as well.  They are in their electoral campaign going everywhere in television programs and they have not said a word of the comrades of Las Heras. Other organizations are calling for a new demonstration on July 26 when the trial is already advanced and possibly even over.

This situation cannot be like this any longer. We must unite and fight it in a single fight with all the ones that fight for wages, against layoffs, against the income tax, persecution, repression and slaughter of the working class. The banners for the defense of comrades of Las Heras and against the fascist trial in session in Caleta Olivia must be from the entire working class and militant students. Workers should be aware that we cannot win any of our demands if the oil workers of Las Heras remain behind bars hostage by the oil companies and the government of Kirchner.
